Committees Advance Pharmacy Legislation

Texas State CapitolA variety of important bills affecting pharmacy have been voted out of committee and are one step closer to becoming law. SB 1056 by Sen. Judith Zaffirini, which clarifies state law concerning collaborative practice, now moves from the Senate Health and Human Services Committee to the Senate floor for a vote by the 31-member body. Texas Pharmacy Association Member Erin Graves and CEO Debbie Garza appeared before the committee March 27 to testify in support of the bill.

Meanwhile, the House Insurance Committee approved legislation concerning pharmacist payment for services and pharmacy benefit manager (PBM) reform. HB 3441 by Chairman Eddie Lucio III, which would increase access to pharmacists’ care by requiring reimbursement for pharmacist-provided services that are within a pharmacist’s scope of practice, was voted favorably out of the committee. TPA Board Member Jay Bueche testified in support the bill on March 26.

HB 2817 by Lucio, which also incorporates several key provisions from HB 2331 by Rep. Tom Oliverson, was voted out of the House Insurance Committee this week unanimously. The bill prohibits PBMs from applying payment reductions after a claim is adjudicated except in cases of legitimate audit outcomes, prohibits contract language that prohibits community pharmacies from delivering medication to patients, reduces certain credentialing requirements, prevents PBMs from paying PBM-owned pharmacies at a higher rate than they pay other pharmacies, prohibits PBM retaliation against a pharmacy because the pharmacy exercised its rights and remedies allowed by the bill, and requires PBMs to specify reimbursement.

In addition, HB 1455 was voted out of committee. The legislation protects pharmacists from harmless technicalities in wholesale invoice audits.
