PBM Reform Compliance Oversight

Two important pharmacy benefit manager (PBM) reform bills passed by the Texas Legislature in 2021, HB 1763 and HB 1919, took effect September 1, 2021. The Texas Pharmacy Association is working with the Texas Department of Insurance (TDI) to ensure compliance with the new provisions.

TDI has not adopted any new rules or guidance related to the new laws. Instead, they plan to review complaints submitted to the agency and determine whether additional steps are required in order to ensure PBM compliance with the new laws. This means it is extremely important to document any violations of the new laws and submit formal complaints to TDI through their online portal. Once you have submitted a complaint to TDI, please also complete the following form to notify TPA so that we may be aware of the situation and follow up with TDI as necessary to ensure compliance with the laws.
