TPA Testifies Before Joint Legislative Committee Regarding PMP

Texas Pharmacy Association CEO Debbie Garza was invited to testify October 3 on behalf of the pharmacy profession before the Texas legislature’s Interim Joint Committee on Prescribing and Dispensing Controlled Substances. The committee is co-chaired by Rep. J.D. Sheffield and Sen. Charles Schwertner, the only pharmacist serving in the legislature. Garza’s testimony regarding the state’s Prescription Monitoring Program, or PMP, included input from other Texas pharmacy organizations. Garza assured the committee that Texas pharmacy remains committed to working with the state and other health care providers to find meaningful solutions to the opioid crisis and to the broader misuse of prescription medications.

“We believe it is critical that health care providers and legislators work together to ensure that the PMP is a system that can be seamlessly integrated into the demanding workflow of pharmacists and prescribers,” Garza said. Among TPA’s recommendations were that the legislature (1) provide legal immunity to Texas practitioners not submitting prescription data to the PMP or accessing the PMP database as required, (2) specify that PMP data is not available to the public nor subject to open record laws, (3) establish legal penalties for wrongful use of the PMP, and (4) review an oversight in the current statute that would require a pharmacist to check the PMP prior to providing a refill.
